On August 6, 2019, CMS finalized its 2020 hospice rule, including adopting, without substantial modification, two controversial and material changes to the hospice benefit: Rebasing payment rates to shift about $500 million from routine care to enhanced levels of care including general inpatient, continuous, and respite care. In response to the FY 2015 Hospice Wage Index and Payment Rate Update proposed rule (79 FR 26538), a commenter suggested that hospices have difficulty contracting for respite care in many areas because the hospice respite rate may be $5 to $50 less per day than the facility's Medicaid rate. On August 6, 2019, the Centers for Medicare & Medicaid Services (CMS) published a final rule updating the Medicare hospice payment rates, wage index, and the quality reporting requirements for fiscal year (FY) 2020. The change represents a $540 million raise in hospice payments for FY 2020. CMS based the update on a market basket increase of 3.2 percent, less a 0.5 percent multifactor productivity adjustment. If the proposed rule becomes final, CMS would also raise the annual payment cap for hospice by 2.7 percent to $22,993.99. The Centers for Medicare & Medicaid Services ( CMS ) has issued its final rule updating hospice payment rates for federal fiscal year ( FFY ) 2020. CMS finalizes
through September 30, 2020. The hospice cap amount for the 2020 cap year is equal to the 2019 cap amount ($29,205.44) updated by the FY 2020 hospice payment update percentage of 2.6 percent. As such, the 2020 cap amount is $29,964.78.
